8-Stunden-Grenze
Nach § 3 Satz 1 des ArbZG darf die werktägliche Arbeitszeit der Arbeitnehmer acht Stunden nicht überschreiten. Bei der Planung von Arbeitseinsätzen ist dies immer zu berücksichtigen. Ausnahmsweise überschritten werden darf die Zeit dann, wenn die durchschnittliche Arbeitszeit innerhalb von 6 Kalendermonaten die durchschnittliche Arbeitszeit 8 Stunden nicht überschreitet. Dies wird durch die Zeiterfassung gewährleistet. Um dieser gesetzlichen Anforderung nachzukommen ist es daher nicht möglich, einen Antrag auf Rücknahme der Kappung der Mehrarbeit in zwei aufeinander folgenden Quartalen zu stellen. Für Teilzeitkräfte gelten ebenfalls die 8 Stunden, es erfolgt keine anteilige Kürzung.
